Drug reps talking about off-label use is prohibited. That does not mean it's fraudulent. In legal terms it's the difference between malum prohibita (it's bad because it's against the law e.g. illegal immigration) and malum in se (it's bad because it just is, e.g. murder).

I don't like it because it works no better then placebo. It has significant side effects. Also the company that makes it engaged in a massive fraud to convince physicians that it does work. 

My opinion is that the CEO should have gone to jail 
for the companies action.
